An appeals court has affirmed the removal of a Wise County commissioner from office.

The Second District Court of Appeals in Fort Worth affirmed District Judge Roger Towery’s summary judgment removing former Precinct 4 County Commissioner Terry Ross from office. The court issued its opinion on the appeal Dec. 23, just two days before Christmas. Oral arguments were heard in October. Ross was removed from office by Towery in March as the result of a civil suit filed by retired Texas Ranger Lane Akin in June of 2012 while Ross was at the center of a theft investigation. Ross ended up pleading guilty in 2013 to a related criminal charge, abuse of official capacity, but was fighting the civil suit to possibly recover back pay from the county.
